The terms “we”, “us” and “our” refer to Outlaw Equine. Outlaw Equine operates this website and online store, including the information, content, features, tools, products and services made available through it.
Our online store is powered by Shopify, which provides the ecommerce platform that allows us to sell our products to you.
These Terms of Service, together with our Privacy Policy, Returns and Refunds Policy, Shipping Policy and any other policies displayed on our website, explain the terms that apply when you browse our website, create an account or purchase from Outlaw Equine.
By accessing or using our website, placing an order or purchasing a product, you agree to these Terms of Service.
Please read these terms carefully before using our website. Should you not agree with these terms, you should not access the website or use our services.
SECTION 1 – ELIGIBILITY AND ACCOUNTS
By using this website, you confirm that you are at least 18 years of age or have permission from a parent or legal guardian to use the website.
When placing an order or creating an account, you may be required to provide information including your name, email address, billing details, payment information and shipping address.
You agree that all information you provide is accurate, current and complete.
You are responsible for maintaining the security of your account details and password and for any activity carried out through your account.
You must not transfer, sell, assign or provide your account to another person without our written permission.
SECTION 2 – OUR PRODUCTS
Outlaw Equine sells equine products and accessories, including western saddle pads and related products.
We make every reasonable effort to ensure product descriptions, measurements, photographs and videos are clear and accurate.
However, product colours may appear differently depending on your device, screen brightness, display settings, colour calibration and surrounding lighting. We cannot guarantee that the colour displayed on your device will exactly match the product in person.
Many Outlaw Equine products are made from natural fibres, including wool. Small variations in colour, weave, texture, measurements or finish may occur between products and are part of the natural characteristics of the material and manufacturing process.
These reasonable variations are not considered manufacturing faults.
Product measurements are approximate unless otherwise stated.
We reserve the right to:

Product availability is not guaranteed. Products may sell out or become unavailable without notice.
SECTION 3 – PRODUCT USE AND HORSE SAFETY
Products sold by Outlaw Equine must be used appropriately and for their intended purpose.
It is the customer’s responsibility to:

Check that a product is suitable for their horse, saddle and intended use

Inspect the product before each use

Ensure all equipment is correctly fitted

Monitor the horse for rubbing, pressure, discomfort or irritation

Stop using the product should damage, excessive wear or a fitting issue become apparent

Follow any product care and cleaning instructions provided
Horses are unpredictable animals and equestrian activities carry inherent risks.
Outlaw Equine is not responsible for injury, loss or damage caused by incorrect fitting, inappropriate use, failure to inspect equipment, misuse, mistreatment, ordinary wear and tear or the behaviour of a horse.
Nothing in this section excludes any rights or remedies that cannot legally be excluded.
SECTION 4 – ORDERS
When you place an order through our website, you are making an offer to purchase the selected products.
An automated order confirmation does not necessarily mean that your order has been accepted. Your order is accepted once payment has been successfully processed and we confirm that the order can be fulfilled.
We reserve the right to refuse, limit or cancel an order where:

We suspect fraudulent or unauthorised activity

Payment cannot be verified or processed

Shipping is unavailable to the address supplied

Should we cancel an order after payment has been processed, the amount paid for the cancelled item or order will be refunded.
Please check your order carefully before submitting it. Once an order has been processed or packed, we may be unable to change or cancel it.
Purchases are also subject to our Returns and Refunds Policy.
SECTION 5 – PRICES AND PAYMENT
All prices displayed on our website are in Australian dollars unless otherwise stated.
Where Outlaw Equine is registered for GST, displayed prices include GST unless stated otherwise.
Shipping charges are calculated separately and displayed during checkout.
Prices, discounts, promotions and product availability may change without notice.
The price charged will be the price displayed at the time your order is submitted, except where an obvious pricing or system error has occurred.
We may cancel an order affected by an incorrect price, description, promotion or discount. Should payment have already been received, we will refund the affected amount.
You agree to provide accurate and complete payment and billing information.
By submitting payment details, you confirm that you are authorised to use the selected payment method.
Payment transactions may be processed by Shopify Payments, PayPal, Afterpay or another third-party payment provider. Your use of these payment options may also be subject to the provider’s own terms and conditions.
We do not directly store complete credit card details.
SECTION 6 – PROMOTIONS AND DISCOUNT CODES
Promotional offers and discount codes may be subject to separate conditions, including expiry dates, minimum spends, product exclusions and usage limits.
Unless otherwise stated:

Discounts do not apply to shipping costs

Promotions are available while stocks last

A discount code has no cash value

Change-of-mind returns for sale or discounted products are handled according to our Returns and Refunds Policy.
SECTION 7 – SHIPPING AND DELIVERY
Orders will be shipped to the delivery address supplied during checkout.
Customers are responsible for checking that their name, delivery address and contact information are complete and correct before submitting an order.
Shipping and delivery timeframes are estimates only. Delays may occur due to postal or courier services, weather, natural disasters, peak periods, regional delivery limitations or other circumstances outside our reasonable control.
We are not responsible for delays caused by a shipping carrier or circumstances outside our control. However, we will provide reasonable assistance should an order become significantly delayed or appear to be missing.
Customers must contact us as soon as possible should they notice an error in their delivery address. We cannot guarantee that an address can be changed after an order has been processed.
Additional delivery costs caused by an incorrect or incomplete address, a failure to collect the parcel or a parcel being returned to us may be charged to the customer.
Any authority to leave request is made at the customer’s risk, subject to any rights available under applicable law.

SECTION 8 – RETURNS, REFUNDS AND FAULTY PRODUCTS
We do not accept returns, exchanges or refunds for change-of-mind purchases, except where we expressly agree otherwise.
Change of mind includes:

Selecting the wrong colour or design

Deciding that the product does not suit your horse or equipment

No longer wanting the product

A colour appearing differently in person due to screen or device settings
Faulty, damaged or incorrectly supplied products will be handled in accordance with our Returns and Refunds Policy and the Australian Consumer Law.
Customers must contact us before returning a product and provide the requested order information, photographs or videos so that we can assess the issue and provide return instructions.
Nothing in these Terms of Service or our Returns and Refunds Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified.
SECTION 9 – BIOSECURITY AND RETURNED EQUINE PRODUCTS
Biosecurity and hygiene are important when handling products used on or around horses.
Unless a product is being returned as part of an approved faulty-product claim, items that have been placed on, fitted to or used on a horse cannot be returned.
Returned products must comply with the condition requirements set out in our Returns and Refunds Policy.
We may refuse unauthorised returns or products returned in an unhygienic condition, subject to any rights the customer may have under Australian Consumer Law.
SECTION 10 – INTELLECTUAL PROPERTY
Unless otherwise stated, the content available through the Outlaw Equine website belongs to Outlaw Equine or is used with permission.

Outlaw Equine is powered by Shopify, which enables us to provide our online store and related services.
However, all purchases made through the Outlaw Equine store are made directly between you and Outlaw Equine.
Shopify is not the seller of Outlaw Equine products and is not responsible for fulfilling orders, assessing products, providing customer service or resolving disputes relating to purchases made from Outlaw Equine.
To the extent permitted by law, Shopify and its related entities are not liable for injury, damage or loss arising from products purchased directly from Outlaw Equine.
